This Privacy Policy (“Policy”) describes how Live It Earth Productions, Inc. (“Live It Earth”) that is incorporated in Canada only (collectively, “we,” “us,” or “our”) collect, use, and otherwise process personal information about our customers and users of our websites and services. Live It Earth is a British Columbia corporation whose main office is located at 1481 Knox Rd. Nelson, B.C., V1L6T4

To deliver our products and a range of services to meet your needs, we need to collect some personal information as well as data on how you use our websites.

This policy outlines our commitment to you and the security of your data. It explains our approach to online information collection, storage and use in connection with this site, as well as the specific choices you can make about your own information. Please read this Privacy Policy carefully in order to understand how any personal information collected by us is used.

By using the site or requesting the provision of services you will be deemed to have read and understood this Policy. If you do not agree with this Policy, please do not use the site.

This policy DOES NOT apply to: • Personal information we collect offline or through any other means except as provided for herein. • Information that you provide to or is collected by any third party, including through any third-party application or content that may link to or be accessible from or on the Websites or Services. These third parties may have their own privacy policies, which we encourage you to read before providing information to them.

1. Who we are

Live It Earth is an online education service provider that produces and delivers high-quality, interactive programs for K-8 students and teachers. Each program includes a 25 minute feature show, teacher resources, self-assessment tools, learning challenges and other rich content. Our programs make life easier for teachers and engage students in fun, meaningful learning experiences. We produce our programs in French and English and include Indigenous worldviews.

2. Information you provide us and how we use it

We collect and use your personal data, service usage data and other information provided for our legitimate interests so that we can make our services available to you, provide services you request, administer the services and suggest similar products to you that you may be interested in.

We collect the following types of personal information from you when you access our Websites and Services. The most common of these circumstances where you would provide personal information and the categories of personal information we collect in those circumstances include the following: 

i. Purchasing a Subscription. When you purchase a subscription to Live It Earth, we may collect information necessary to process your transaction, including your name, email address, mailing address, phone number, payment information, such as a credit card number and/or other related  information that may be required from you to complete your purchase (“Financial Information”). Unless we tell you otherwise at the time of your purchase, we do not collect, store or maintain your Financial Information; rather this information is handled by our Service Providers. For more information on how your information is shared in these instances, please see the “Third-Party Payment Processing” Section below. 

ii. Using Our Websites and Services. In order to use certain features of our Websites and Services, you (or your school) may be required to create a password-protected user account and provide us with personal information, including first name,  last name,  password, teacher email. We will store and use this information to administer the Websites and Services in which you choose to participate. 

iii. Contacting Customer Service. When you contact our customer service, we may ask you to provide, or confirm, personal information, including your first and last name, job title, email address, phone number, city, state, school or district, so that we can better serve you. 

vi. Challenges, Promotions, Contests or Sweepstakes. If you enter a challenge, promotion, contest, or sweepstake, we may ask you to provide personal information, including first name, last name, birth date and/or age, home address, email address, grade, school, and/or a video, so that we can consider your entry and, if you win, so that you may redeem your prize. 

vii. Newsletters. We may collect your email address, first and last name, and postal code if you sign up to receive our newsletters. 

viii. Participating in a Survey or Providing Feedback. We may contact you to participate in surveys or provide feedback. If you participate in a survey, we may ask you to provide personal information, including your name, job title, headshot, grade level you teach, your school name, and your school district for internal analysis, research studies, and to support product and services development.

 ix. Promotional or Marketing Communications. If you sign up to receive promotional communications or notifications from us, we may ask you to provide personal information, including name and email address, so that we can provide these to you. 

x. Student Questions. From time to time, we may want to feature questions and comments we receive from you and your students. To submit a Featured Question, we will send you a permission form to obtain appropriate consent from the student’s parent or legal guardian for the student to appear in the Feature Show. We collect the name and email address of the parent/guardian and the name of the teacher, and the first name of the student and their grade. Participation in this recorded video is optional, and we will never proceed without a signed consent form. 

xi. Interactive Features. We may offer interactive features such as commenting functionalities, “likes,” chat services, review forums, tips, and social media pages. We may collect the information you submit or make available through these interactive features. Any information you share on the public sections of these channels will be considered “public” and is not subject to privacy protections referenced in this Policy. We may access and use any of your public reviews along with your member profile name for any purpose, including marketing. 

xii. Professional Development, Training Conferences, Trade Shows, and other Events. We may host professional development and training events, and may attend conferences, trade shows, and other events where we collect personal information from individuals who interact with or express an interest in us and/or the Services.

 xiii. Registering for Events. When you register for an event, such as conferences or professional development, we may collect your name, job title, professional email address, phone number, mailing address, province, school district, and school name during the registration process. 

xiv. Referrals. Some of our Services may allow you to refer other educators to use our Services by providing their names and email addresses. We will use the email addresses you provide to send an email inviting the recipient to use our Services. If the recipient does not respond to the invitation, we may send a single reminder email. 

The above list provides examples of the personal information that may be collected when using our Websites and Services. If you do not want us to collect your personal information, please do not provide it to us.

3. Who we will share your personal information with

  • We do not and will not sell your personal data to any third party, however we may share your personal information with our current or potential commercial partners e.g. agents, investors and sponsors etc.

  • We will only use your personally identifiable information for marketing purposes or share your personally identifiable information with anyone else for marketing purposes if you have specifically consented to that. Remember that you can opt-out of these again at any time - see Your rights section below. In all cases the information will be securely stored with our CRM and marketing systems (Hubspot). Data kept for marketing purposes can be updated at any time by clicking on the unsubscribe link that appears in all our email communications. You will have the option to update your marketing preferences linked to your email address or deselect yourself from all non-account based email communications.

  • Please be aware that it is possible, though unlikely, that we might be forced to disclose personally identifiable information in response to legal process or when we believe in good faith that the law requires it.

4. Where we store your personal information

  • Your information is stored in secure database servers and we employ appropriate technical and organizational security measures to prevent unauthorized access to information that we collect online. Live It Earth aims to ensure that any data uploaded to our systems is secure in transit and at rest on our servers. To ensure this we make use of SSL certificates for transfer of data to and from our websites.

  • Our data storage provider is AWS Canada (Central) in their MontrealDigital Oceans in their Toronto data centre. Information on their position on GDPR can be found here: https://www.digitalocean.com/legal/gdpr

  • Your personal information will only be stored as long as we need to use it to service your usage of our websites or services.

5.  Your rights, including opt-in and opt-out provisions:

  • You have the option at any time to request that we provide a copy of the personal information we hold relating to you and we shall try to provide this information to you within one month of your request.

  • You have the right to ask us to update or remove any such personal information. Please note that when we delete personal information from our system your access to the website will be restricted and some areas will not be available to you.

  • You have the right to ask us to stop contacting you where we do this in accordance with your previous consent.

7. Cookies

  • A cookie is a text-only string of information that a website transfers to the cookie file of the browser on a user's computer hard disk so that the website can remember who the user is.   • We use a number of third party services to track website usage, payment processing, site performance and ad-related performance. Please note that third parties (including, for example, advertising networks and providers of external services like web traffic analysis services) may use cookies, over which we have no control. These cookies are likely to be analytical/performance cookies or targeting cookies.

  • You can block cookies by activating the setting on your browser that allows you to refuse the setting of all or some cookies. However, if you use your browser settings to block all cookies (including essential cookies) you may not be able to access all or parts of our site.

9. How long we keep your personal data

  • We retain personal information for as long as it is needed to provide access to the website or to manage your account. We take reasonable steps to delete the personal information we collect three years after your subscription lapses or if it remains inactive (i.e. no log-in) for three years. We will delete your personal data if you opt out of receiving further communications from us or if you ask us to delete your information. We may however retain and use personal information to comply with our legal obligations, to resolve disputes and to enforce our agreements.

  • We may retain and use anonymous and aggregated information for performance reporting, benchmarking and analytic purposes and for product and service improvement.
